Terms of Service
The operator and the service
Balloonhead is operated by Damian Mathew Bishop, a sole trader in Poland, ul. Wierzbięcice 44a/40A, 61-568 Poznań, Poland; NIP 7773472578, REGON 545258794. Contact and complaints: [email protected].
These terms cover the game at balloonhead.games and its desktop client. Basic play is free; optional purchases, when available, are identified separately. You may use the game for personal play subject to these terms and applicable law.
Your account and fair play
Keep your sign-in access secure and tell us about suspected unauthorized use. Clearing a guest token can make an unlinked account inaccessible. If you are a minor, obtain any permission required by the law applicable to you; do not make a purchase without the payment holder’s authorization.
Do not cheat, deliberately exploit bugs for gain, tamper with the network, disrupt the service, harass others or use unlawful or impersonating names or messages. You retain your rights in content you submit and allow us to store and display it as needed to provide the relevant game feature.
We may restrict access to address abuse or security risks. If your account is restricted, contact us to request a review. We do not treat a server result as preventing you from reporting an error or exercising your legal rights.
Virtual coins, gems and items
Coins, gems, riding pots, cosmetics and companions are usable inside the game. We do not offer redemption for real money or real-world prizes, and the game does not provide a player-to-player real-money marketplace. An in-game “cash out” banks virtual coins; selling a Pal through the game returns virtual coins, not money.
Dice, coin, Road, spin and case features involve chance and can use up the virtual currency indicated. They do not guarantee a win. Gem packs can be bought with money where checkout is enabled, and some content or case openings can cost gems. Therefore, “virtual currency” does not mean that every item or chance-based feature is free. Check the displayed price, outcome rules and case odds before confirming.
We may adjust game balance and free rewards. Changes do not remove any mandatory rights you have concerning purchased digital content or services.
Payments, withdrawals and problems with purchases
The checkout shows the pack, price, currency and payment provider before payment. Browser gem checkout uses Stripe where enabled. These terms do not promise Steam purchasing or a payment method that is not available in the game.
EU consumers generally have 14 days from concluding an online digital-content contract to withdraw without giving a reason. A digital-content exception requires the legally required prior express consent, acknowledgement of loss of the right and contract confirmation. Merely using the game or accepting these terms does not waive that right. We do not apply a blanket “all sales final” rule.
To withdraw or report missing gems, an incorrect charge or defective content, email us with your player identifier, purchase reference if available, and a description. For withdrawal you can write: “I withdraw from my purchase of [pack], ordered on [date], reference [reference], name [name].” Do not send payment-card details. Applicable statutory refund and digital-content remedies remain available, including where a purchase has already been credited.
We answer consumer complaints within 14 days of receipt unless a different statutory rule applies, and handle refunds within the applicable legal deadline. See UOKiK’s information on withdrawal and digital-content exceptions.
Availability and changes
Online play requires a working connection and compatible device. Maintenance and faults can interrupt the game. We may update features and provide notice of material changes where required. Nothing here excludes mandatory rights relating to availability, conformity, refunds or liability.
You may stop playing or request account deletion. Deletion removes access to the account’s progress and unlocks; it does not waive outstanding consumer claims. See the Privacy Policy for data handling.
Applicable law and disputes
Polish law applies, without depriving consumers of mandatory protections available under the law of their country of residence. Nothing in these terms requires consumers to use a court that mandatory law does not permit or prevents a complaint to a competent authority.
Updates to these terms
Revisions will be dated and published here. We will notify players of material changes and obtain agreement where required. Changes do not retroactively remove accrued rights.
